President Biden’s official nomination for president may happen too late for him to appear on Ohio’s general election ballot, according to Ohio Secretary of state Frank LaRose.

Ohio state law requires certifying candidates for its presidential ballot by Aug. 7. However, the Democratic National Convention isn’t until Aug. 19 in Chicago, too late to meet Ohio’s deadline.

Rose sent a letter Friday outlining this to the state Democratic Party chair. In it, he outlined two ways to fix the problem: change the date of the convention, or have the state legislature change the law by May 9.

It’s uncertain how easy either would be. Ohio is a “trifecta” state, with Republicans controlling the state House, Senate, and governor’s office. The Biden campaign said it was “confident that Joe Biden will be on the ballot in all 50 states.”
