I'm not believing the 5000 number either.
Anyway, I think the senior management is stupid and didn't consider the possibility that lower level employees would be doing stuff like this to get a bonus. Given all the data showing how well they were cross-selling product and never a red flag did they see. I left Wells Fargo in 2010 and even then I suspected that this was going on, and I worked in a completely different part of the company that had nothing to do with this.
As goes the old saying from the movie "CASINO" with Joe Pesci and Robert DeNiro:
"Either you were in on it or you were too incompetent to see it was happening". You don't have to choose which it was since your fate will be the same...

Same reason Bush, Cheney, Obama, and Hillary aren't in jail. Two sets of rules: one set for commoners like you and me and one set for the nobles. Our society never fully recovered from the Medieval Age. We just call the nobles by different titles.
Jailing CEO John Stumpf for 6mo would do wonders for cleaning up the banking industry.
Six months? If you or I committed just one time the financial fraud these executives commit on a daily basis, we'd get ten years in prison. The nobles should be punished as much as the peasants.

With 265,000 global employees, it's possible that the managers of the bottom managers could have a clue, but not pass it upward for fear of consequences. Possible, but I don't believe it.
