I intend to say "Yes, I have vaccinations". Because I have had them: MMR, Polio, etc.


TAMPA (WFLA) – Can your boss legally ask if you’ve received the COVID-19 vaccine? And if you haven’t, can your employer force you to get it?

Whether you’re already back at work or plan to return soon, you may have questions about what comes next as we return to normal.

According to experts in employment law, Florida employers can ask questions about the COVID-19 vaccine but legally, they can’t verify anything you say.

In Florida, the honor system rules.

“How are you going to know if someone has it? Are we mandated to carry our card on us at all times?” said McKenzie.

Brian Koji is a Labor and Employment Attorney at Allen Norton & Blue, P.A..

“Essentially, you’re on the honor system,” said Koji.
Rule 1:

Your boss can ask if you’ve received the COVID-19 vaccine. That’s not considered to be an unlawful and intrusive medical question, according to recent federal guidance.

“Could they ask if you’ve had COVID?” asked 8 On Your Side Investigator Mahsa Saeidi.

“Your boss can inquire about that,” said Mr. Koji, “however…they have to show that it’s job related.”
Rule 2:

Your boss cannot ask follow-up medical questions unless they show it’s job-related. For example, it would be a job-related question for those in the healthcare industry.

But could your boss require that you get vaccinated as a condition of employment?

“We’re obviously in uncharted territory here,” said Mr. Koji. “Push comes to shove, it’s our view that you can require it.”
Rule 3:

Your boss can require the COVID-19 vaccine as a condition of employment.

Koji says, right now, most Tampa Bay area employers are choosing to just encourage the vaccine, instead of mandate it.

There’s one major takeaway for all Floridians.

“Public employers, private employers, none of them can require documentation of vaccines,” said Mr. Koji.

Mr. Koji is referring to a Florida law that bans so-called vaccine passports.

Again, although your employer can require the vaccine, they cannot make you prove that you’ve actually had it by showing documentation.

Dear Citizens. Just an FYI. There is no national database in the USA of vaccinated people. Technically speaking there is a mishmosh of healthcare data systems that do not talk to each other. You know how I know this? I worked in healthcare administration for 20+ years in the IT field, the systems don't talk at all. Whilst there is a move via HL7 to send data back and forth. Why do you have to fill out demographic info at every healthcare office you ever visit? The gov't would be knocking on doors if they actually knew who was not vaccinated. They have no idea who is and who isn't vaccinated. OSHA I promise does not have the bandwidth or capability to enforce any of this stuff. They are probably just sitting in their offices today stunned.... Any OSHA whistleblowers out there?

OSHA cannot enforce this mandate.


I'm pretty sure this is true. There is no national database. IT is really fragmented and fucked up as a rule.

This mandate is only to manipulate the California recall election, and to provide cover for Nancy's wall being put back up at the Capital.

Nancy and Biden needs that wall back up for when the clamoring starts growing for his whole regime to stepdown after the audit results are made public.
Newstink, needs the vax mandate to stoke the fires of division, so that the "I'm voting against Elders" idiots will get out and vote against Elders instead of voting for Newstink.

Because face it, nobody in their right mind is planning on voting for Newsome, unless a big enough rift is created that will lather up the Commie base into voting out of spite, instead of for a purpose. The retarded part is, there's still plenty of Democrats not vaccinated, but they realize they are exempt, all they have to do is claim homeless, immigrant, protest status, and they are exempt from the ire of getting a vaccine, and they aren't a threat to our health like Trump supporters are.

My bet is that it does not blow over at all, but they attempt go yet further with it regardless of the CA recall result.

As long as the money rolls in to Pfizer et all and government sees that it's useful for gaining absolute power, dividing the public, and distracting them from Biden's disastrous failure in Afghanistan, it will continue.

No "national database" is slim comfort. They will do checks on vax papers by contacting the provider listed. For example, if you have a Covid jab paper listing CVS as the provider, they will contact CVS to see if you are in their records. If not in the CVS records, you will be prosecuted as a forger. It is not a stretch that companies will be required to keep a copy of all employees jab paperwork, and OSHA can send out agents to spot check some of these records. Grab a batch of forms that list CVS, then check with CVS and find the phonies.

No one can disclose your medical information to another without first getting your consent authorization to do so. Not doing that is the HIPPA violation.

Essentially there will be no way for employers to check the validity of the documents you provide them if you didn’t sign a release of information form with the entity that you got the jab from. Think about it for a minute if you don’t get it. My work is threatening disciplinary actions if they find out that your documents are fraudulent. Again, just how will you verify that?

Yes, but they have to arse themselves to both. Since employers are largely going to be ass-covering, they won't go out of their way to find out things that only create more aggravation for themselves.

"What if they find out?"
"Why would they want to find out?"

This is cold comfort, though.
