Parler Sues Amazon Over Removal From Servers

(Bloomberg) -- Parler, the conservative social media platform whose traffic has surged amid a crackdown on inflammatory content by its rivals, sued Amazon.com Inc. for shutting its site down in the wake of rioting at the U.S. Capitol last week.

The site, which describes itself as a “microblogging alternative and competitor to Twitter,” was taken offline early Monday morning by Amazon’s cloud services division. Apple Inc. and Alphabet Inc.’s Google had withdrawn Parler from their app stores over the weekend.

Amazon’s shutting the site down “is the equivalent of pulling the plug on a hospital patient on life support,” Parler said in a lawsuit filed Monday in federal court in Seattle. It seeks an order forcing Amazon Web Services to maintain its account.

AWS “will kill Parler’s business -- at the very time it is set to skyrocket,” according to the suit.

Antitrust Claim

A spokesperson for AWS declined to comment on the suit. In a letter to Parler filed with the court, Amazon said it couldn’t provide services to “a customer that is unable to effectively identify and remove content that encourages or incites violence.”

Parler alleges an antitrust infraction.

“Less than a month ago, AWS and Parler’s competitor, Twitter, entered into a multi-year deal,” according to the suit. “Late Friday evening, Twitter banned President Trump from using its platform, thereby driving enormous numbers of its users to Parler. Twenty-four hours later, AWS announced it would indefinitely suspend Parler’s account.”

Parler claims that by suspending its account, AWS “will remove from the market a surging player, severely restraining commerce in the microblogging services market.”

It also claims that AWS broke its contract, which it says requires more notice of termination, and illegally interfered in its relationship with its customers.

Surging Business

In the week after Election Day, Nov. 3, Parler became the top free app in Apple’s iOS App Store, up from No. 1,023 just a week earlier, according to the suit. It said installs increased 355% after Twitter said it would permanently ban Trump.

AWS is by far the largest cloud-computing provider, and its on-demand software services are the backbone for many of the most popular Internet services. Parler has ”no other options” to be on the web, it said.

The case is Parler LLC v Amazon Web Services Inc., 21-cv-31, U.S. District Court, Western District of Washington.

Eventually you guys are going to realize we don't have free markets, or a judicial system.

Amazon is what, a trillion dollar company? They'll just keep this in court for the next decade. They may win, eventually, but they'll be long dead as a company before they do.

Amazon is what, a trillion dollar company? They'll just keep this in court for the next decade. They may win, eventually, but they'll be long dead as a company before they do.

Most likely they will be thrown a microscopic bone of a few hounded thousand $ that is woefully insufficient

A legal campaign is being launched by the “Coalition for a Safer Web,” an NGO that has sued Apple in a bid to get the giant to remove the Telegram messaging app from its store.

Such a move would solidify the recently emerging practice of censorship at a lower infrastructural level, including by revoking hosting and removal of entire apps from app stores, instead of banning or muting individual users and accounts.

According to the group, Telegram should be banned from the App Store because its users post hateful content, which puts people in danger as an iPhone owner, and also causes emotional distress.

The case, filed in US District Court for Northern California, accuses Apple of not enforcing its terms of services, and Telegram of being a “superspreader” of “hate speech” and incitement to violence – incomparable “even to Parler.”

This is super idiotic, as Apple can change their own terms of service in seconds making the case moot. Then after it's dropped or thrown out they can change the terms back. Rinse, repeat. =))

I joined Parler during the "campaign" and checked it out a couple of times. I just checked and there is not much to see there.

Funny thing about critical mass and momentum. Will Parler ever get back to where they were? Were they ever really there?

I shamefully admit that I still follow my friends and family on Fbook. I still like my friends pictures and I still try to futilely "debate" some liberals I know, but I no longer post pictures or start conversations. I spent a couple hours this afternoon browsing the covid reaction group on my way home from skiing this afternoon. I usually can only stand a couple of minutes of Fbook propaganda after I check if anyone I know has died before I have to shut it down. I don't expect the virus reaction group to last.

Maybe Parler can replace twitter which I never used anyway.

What can replace Fbook? If there was a new platform how can I get a critical mass of my friends and family to join me?

It's possible for everyone to keep their "profile" and friend list on their own laptop or phone, and then selectively share that.

The technology is not hard. Just use rsync over ssh. Most programmers are familiar with those.

The problem is that it would not be profitable, because it would be totally controlled by you, and you wouldn't put ads on it.

Well, another problem is that incoming connections to your laptop and phone are most likely blocked by your ISP or cell carrier.

So no one really works on it. I think there are a few open source attempts, but obviously none of them have caught on yet.
