If you're on Android, you can disable auto updates:

Pull up Settings again and scroll down until you see the “About phone” section. Tap on that. Then, tap on the “Software Information” section, and scroll down until you see “Build Number.” Start tapping on that section until your device says that you’ve enabled “Developer mode.”

Then, head back to your primary Settings screen and scroll down. You should see a new “Developer options” section near “About phone.” Tap on it, and then look for the “Automatic system updates” option. Make sure it’s not enabled.

Does that executive order have any teeth? Why is it not being enforced?

Here's what they're probably going to do: Update the phone so the default to getting government alerts is "No" instead of "Yes". Since 95% of iPhone users have probably never bothered with it, they'll never know. Lawyers probably brainstormed for hours to figure out a way to do it, without explicitly violating the law, which probably says they must provide a mechanism for the alerts. Since the law long predates modern electronics, and TVs/radios are one-way comms, they never anticipated a company providing users the means to turn it off to the user or setting it to off via default settings. Pretty sure there is no "Turn off Emergency Broadcasts" on a 1959 Vacuum Tube Zenith BW TV menu option.

Of course, any half-way decent judge would see right through the bullshit and look at the timing and motive of Apple vs. spirit of the law, but half-way decent judges are rare today.

Oh, there would also be the issue of the SIM Card provider being liable or not preventing Apple or Apple not giving THEM notice, since I imagine it's the carrier that is really responsible for broadcasting the signal. IE AT&T.
