Judge rules Gov. Tom Wolf's pandemic restrictions are unconstitutional

HARRISBURG, Pennsylvania (WPVI) -- Gov. Tom Wolf's pandemic restrictions that required people to stay at home, placed size limits on gatherings and ordered "non-life-sustaining" businesses to shut down are unconstitutional, a federal judge ruled Monday.

U.S. District Judge William Stickman IV, who was appointed by President Donald Trump, sided with plaintiffs that included hair salons, drive-in movie theaters, a farmer's market vendor, a horse trainer and several Republican officeholders in their lawsuit against Wolf, a Democrat, and his health secretary.

The Wolf administration's pandemic policies have been overreaching and arbitrary and violated citizens' constitutional rights, Stickman wrote in his ruling.

The governor's efforts to slow the spread of the coronavirus "were undertaken with the good intention of addressing a public health emergency. But even in an emergency, the authority of government is not unfettered," Stickman wrote. "The Constitution cannot accept the concept of a 'new normal' where the basic liberties of the people can be subordinated to open-ended emergency mitigation measures."

The ruling means that current restrictions, including ones that limit the size of indoor and outdoor gatherings, can't be enforced, according to attorney Thomas W. King III, who represented the plaintiffs.

It's just lovely the way the courts saunter in months and months after the facts, when all the damage is done, to make their ponderous declarations. Oh, the bill will be 50 million for this spot of obvious wisdom.

Bingo. Not always good to make quick decisions in the moment, but it's flipping October at this point. The evidence has been there since late May and early June at latest to keep the "emergencies" and "executive orders" in place. Protect the old. If you're worried about the virus stay home and don't bitch at people because you left the house. Not a complicated formula.

Oh, and don't sneeze or cough on people. We've already seen what that's done to 200k+ people.

The courts seemed fast enough when it comes to items like stopping Trump's travel bans.....

Since his orders were unconstitutional, I'm sure the FBI will immediately charge him for making terrorist threats.

Since the Michigan governor's actions were deemed unconstitutional, I'm sure the FBI will charge the governor with millions of counts of false imprisonment, making terrorist threats, and a bunch of other crimes. I'm certain the FBI will have her sitting in a jail cell with the militia members charged today.

So where is the federal court smacking down on Gavin and the Counties in CA?


Those weren't Federal Courts, but State Supreme Courts. However, since the governors' orders weren't legal, they can be charged with federal crimes. I doubt the court system in California. You gotta wait for the cases to wind through federal court....that could take a few decades.

...and if you think they will be charged at the Federal level, you just don't know what country you're living in.

I will still stand by the statement that the governor won't be charged with a federal crime.
