What should you know if you are in a car crash and you aren't at fault and you were crashed into going 40 MPH and your car is totaled?

Jeez I'm sorry probably best to not say anything and team up with one of those greedy lawyers asap. Do not trust your insurance, get a lawyer if it was serious. And make sure you don't get chalked up as Covid 19 related injury.

I usually hate lawyers and ambulance chasers in the US but you can't trust anyone esp. in CA. Do you have uninsured motorist insurance? Also I had a very mild accident where I had to go to small claims court to get my money because my insurance scammed me by teaming up with the other guys and changing his story though he readily admitted fault. If you have serious financial and/or medical damage then get a lawyer.

Depending on which state you are in, there is either fault established or it’s “no fault.”

California is a fault state, herewith my story.

I was crashed into by a reckless driver, and my truck was totaled and I was hurt.

I didn’t have a lot of insurance because I thought the truck wasn’t worth much.

I used up my insurance coverage first to pay for my medical bills.

Later I learned that the other guy had minimal insurance (minimum in California was $25,000).

The money you can get is limited therefore by insurance coverage.

Financial loss is 1. Vehicle 2. Your lost wages 3. Bills to fix you up (medical)

A potential payout is a multiple of #3, plus 1+2.

Somehow my lawyer got 2 insurance companies for the driver involved, perhaps his employer.
Either way, the maximum amount to get was $25,000+$25,000

My passenger didn’t have much injury, but a little shoulder damage. Luckily for him an MRI could show a little bit of damage, so he just asked the insurance company for the insurance coverage that the driver had, $25,000

I did a ton of paperwork and was deposed by two lawyers, and I ended up with $37,000

I also got a few thousand bucks for my wrecked truck.
The problem was I lost work, and clients which was a permanent effect.

I got T-Boned the a few years ago just a half a block down my street. It's a hot spot for this accident, it's an intersection that people use to beat the slower traffic one street over on the main thoroughfare. To make matters worse, the neighbor there at that intersection has heavy landscaping(and the City still hasn't told him to get rid of it) right at the stop sign out to the street. People have to pull up past the stop sign to see the right side approaching traffic. It makes it hard for when I do take that route to turn onto my street, because someone is halfway out in the intersection. I could give them the look and call them an asshole, but I know it's not their fault.

One day a few years back and glanced over to my .left then my right, and then gunned it, but in that short glance to my right, the car was in the blind spot of these huge windshield posts that are on modern new cars. I've counted 2.75 seconds, that a car, motorcycle or even more for a pedestrian remains in that blind spot, so by time I gunned it, the car was already there.

The insurance company called me, and of course I fessed up that it is ultimately me that had the stop sign, even though I offered up excuses for the other factors.
I lost my cheap cheap cheap auto insurance from State Farm because of it.

I retrospect judging by how badly he damaged my car, the other guy was hauling ass well over 40 when he shouldn't have been over 20. Had he been going the proper speed limit, the collision would have been a mild fender bender. They should have totaled my car, the insurance had it towed to a place that gave them a $8K estimate(the maximum before they would consider it totaled and paid for a new car) the body shop ended up billing over $12K when all was said and done. I really got screwed all around on that deal.
It was the shithead going to fast. He was an illegal alien, who borrowed his roommates car, they had no insurance.

If they were going the proper speed there would have been no accident.

My philosophy driving in neighborhoods is always be prepared to stop so that the fastest a kid can hit me is running speed.

The guy admitted his fault in front of me and my friend, his bossy wife screamed in his ear to back up cause she had seen a parking space, so he backed up right into my car. So I thought the insurances will take the statement and his insurance will pay. Turns out they collude, told the guy to change his story so that they both can say it's his word against mine so neither insurance has to pay but he'll keep his current rates for not being at fault. My insurance told me they are not going to release my documents to me unless I sued them. So I threatened to, eventually obtained one document with the recording of the guy admitting his fault and took him to small claims court and won within 15 minutes. Do NOT trust insurances, not even your own. Later the guy said he should not have done this and just paid me the money upfront and saved the court hassle but his insurance advised him to do so and even sent him with an adviser/lawyer to small claims court.

I had a ghetto broad without license hit my car, it was pouring rain so hard and I was wearing a suit. Wife wanted me to pursue and her and call the police but it's CA, worse SF, and sincey car was fine and everyone else was too I didn't want to sign up for the hassle though she should have been taken off the street. You have not chance to ever see any action or money against illegal aliens or ghetto folks in Commiefornia. One of the reasons to move away despite the beautiful nature.

Rox42, I got a lawyer at his suggestion, I had a bit more hoops to jump through to get a little more money than my passenger. It could have paid off much more if we could show the driver was “in the course of work”, a guy who is working means his employer can be on the hook.

I think the reason was to be sure that my medical expenses would be paid.

Did you get a police report? In Texas, they give you one and generally charge the driver who caused the accident to be at fault, if the damage is more than $1,000.

I have reviewed some earning calls for insurance companies and some have half of their earnings coming from the investing side of their business. Some have assets in the $100B.

Yep - and the insurance companies have placed Event Data Recorders in most new cars. If your car gets in a major accident with large medical bills, you can be sure they will be using this data to build a case against you. Of course, just to make things MORE complicated, state laws vary!! Some states now have laws that allow subponea of EDR info, even though you own the vehicle.

Oh, and forget about disconnecting the black box - it will probably set off the airbags, and you may be subject to prosecution in your state. It's also likely your insurance will be invalid. It's in the fine print of your contract - you did read all the fine print, right?

Social media is a shit hole, but it will probably get you more money than anything, especially if you have a lot of friends/connections. Harder with auto claims, but hit them hard on social. Tag 'em, do whatever you have to. My wife got knocked out at a bar by a door breaking and coming off its hinges. Had to go to the ER. The bar made a FB post about the event that night. They didn't even acknowledge what happened to my wife. So I absolutely blast them.

They had my wife's phone number but not mine. Put them on blast and her and I get a call 24 hours later from the bars insurance company with a $5k offer no questions asked. Ended up with $10k on accident. lol. Social media is a shit hole, but if something bad happens to you through no fault of your own, use it as a tool. Especially if it causes financial and physical issues for you.

I fessed up to it, and took ownership of the accident due to me having the stop sign. It wasn't until later as I reflected on the accident, and looked at the intersection later.
That I realized the guy was speeding down that street. Like Onvacation says

The take away for anyone driving new cars with 4 inch thick Window Posts, a car can be in the blind spot for over 2 seconds. And if you're in a hurry and gun it from the Stop sign like I did that morning. It will put you in front of that car before either of you can say "Oh SHIT!". I now look to my right and count to three at Stop signs.
I have to do it, because Engineers are shit now, and safety is the last thing they can think of in their designs. But hey, I've got a huge curtain airbag there, that no human being has ever kept safe in an auto accident. The fucking thing should have deployed since it was on the side that got hit, but it didn't.

Everyone dreams up new ways for bendable LED screens to Entertain us. Wrapping those thick posts with a screen, and having a camera on the outside, so the post looks as nearly invisible would be a great use of bendable LED tech. But Nah! Who am I kidding, we've got to have a foldable Samsung Phone that will never be released in the US market first. How long have they been teasing us with those phones now? At least 10 to 12 years, where as using it on car blind spots is something they can do now.
And it would probably be cheaper than drive assist tech that's in cars now that is so intrusive, most people disable it.

Also...to start on this thread....Consumers don't know their rights and need to hire personal injury lawyers and I believe consumers sign away their rights to a good settlement too soon. Personal injury lawyers have monopolistic competition and compete with themselves a lot vs the car insurance industry which operates on an oligopoly model. Thoughts?
