A University of Connecticut student who was arrested for using the n-word has narrowly avoided jail.

Jarred Karal was arrested after he was filmed walking through a parking lot and shouting the word “n*gger.” He was with two other individuals, one of whom was also arrested.

The students claimed they were playing a game centered around screaming vulgar words, but were charged under CGS 53-37, “ridicule on account of creed, religion, color, denomination, nationality or race.”

Karal was originally facing up to 30 days in jail, but a judge accepted Karal’s plea for accelerated rehabilitation, under which he will spend 6 months on probation while completing 20 hours of community service.

The student will also be forced to under go “diversity and bias” training.

At the time of his arrest, some observers noted that the treatment of Karal was at odds with the First Amendment.

University of California at Los Angeles law professor Eugene Volokh slammed the Connecticut state statute under which Karal was charged, labeling it “obviously unconstitutional, because it suppresses speech based on its content (and viewpoint), and because there’s no First Amendment exception for speech that insults based on race or religion.”

The Foundation for Individual Rights in Education (FIRE) also told Campus Reform, “FIRE is deeply concerned by the investigation and arrest of two students by the University of Connecticut Police Department pursuant to a statue that any reasonable police officer would have known is unconstitutional. However offensive the use of a racial epithet, not directed at any person, the First Amendment protects offensive language, and neither the University of Connecticut nor its police officers may abridge students’ First Amendment rights.”


Now that the first Amendment has been overtly and deliberately violated, you can be charged with a crime for supporting Trump, or for insulting Trump.

Either way, we all lose.

One may be arrested for supporting Trump, but no one will be arrested for insulting Trump. Just like only a White was arrested for saying the "N" word, but a Black would not be touched if he went around yelling out that same "N" word, or "Cracker," or "Honkey."

They're private and thus not bound to the 1st. It's an edge case and certainly there are good arguments for both sides. Reason makes a case for the lefty here as they're principled defenders of civil liberties without bias. That's rare.

Can you own black slaves in a private cotton farm?

They're private and thus not bound to the 1st. It's an edge case and certainly there are good arguments for both sides. Reason makes a case for the lefty here as they're principled defenders of civil liberties without bias. That's rare.

However, they do receive benefit from student grants, so it may be possible for the federal government to say "no federal funds be directed toward any institution with an anti-constitutional (read: anti-American) position."

The bigger problem here is the unconstitutional law being used against this guy. Seems like the Neo-Bolsheviks have gotten pretty full of themselves after getting so many unconstitutional gun laws in the books that it was time to work on the removal of other rights as well.

You can't but that's because you're violating civil / human rights. Having and keeping a job is not a civil / human right. I agree he shouldn't have been fired. I think Patrick mentioned that CA actually has laws against getting fired for your political opinion IIRC but those obviously aren't strong/precise enough.

Constitution doesn’t state that some rights go away when on private property. All rights there are given equal treatment.

Speech is my civil right too. In reality of course rights have been eroded a lot.

Connecticut itself might have a 1A analogue in their state constitution.

However, the kid has to appeal for it to be struck down, which he should.

Need to appeal AND civil sue the entity that created the law as well as the individuals responsible for its implementation and enforcement. These assholes need to be made an example.

The first amendment is not a law set in stone. It is the first of an enumerated list of "natural rights" that humans have. The government doesn't give us the right to speak, write, think, worship, and assemble with those of like mind. WE THE PEOPLE give the government the right to establish Justice, insure domestic Tranquility, provide for the common defense, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity.

They do not have the right to lock us down and restrict us from making a living. These "safer at home" orders are unconstitutional, as are any law that limit or compel speech.

When the government steps out of line we can withdraw support and exercise our rights.

But you may have to spend some time in the gulag while you wait for the supreme court to get to your case.
