Scumbag CA Department of Real Estate tried to block first amendment rights

I didn't know about this case until today.

Back in 2004, the California Department of Real Estate (DRE) tried to prevent FSBO.com from even listing real estate for sale on a website without a license from them.

This is of course insane, since it's merely advertising the same as is done in any newspaper. The DRE's real reason was to prevent any service which might let the public escape their ongoing mass-ass-raping by the realtor lobby.

Note that Paula Reddish Zinneman, who brought the suit as the commissioner of the DRE, is a "Member or former member of numerous Realtors boards and associations" according to her own website.

She should be imprisoned for conspiring to violate the first amendment, restraint of trade, and belonging to a criminal group that has corrupted our laws at both the state and federal level.

If enough people online want something to happen, it will happen. The web is powerful.

The only question is how to most effectively state our simple demands for fairness so that they will self-propogate and become the overwhelming public will -- unlike "Occupy Wall Street" which never effectively stated anything.

This forum is already a good step in the right direction. 77 people have now read this thread and are a bit more aware of the systemic corruption within the California DRE.

Completely wrong and borderline illegal lawsuits happen all the time, I've seen many of them.

Companies will go at each others throat if they smell money. There is no moral fiber in that business, it's a bunch of crooks and sharks.

It's worse than that though, since this was the state of California's DRE suing to ensure continued unjust profits to realtors.

When corporate-placed agents within the government start suing to prevent free market competition, it's very bad.

The DRE commissioner Paula Reddish Zinneman should definitely go to jail for abuse of public office to protect private profits.

Yes, our government is not completely corrupted by realtors yet. That's good news.

But the fact that a member of the government (commissioner of California DRE) brought suit against FSBO.com to squash free market competition with realtors does not bode well. It shows that the corruption in the DRE goes to the very top.

I agree. Unless there is a cost to trying to violate people's rights, assholes will continue to do so. If they succeed, people's Constitutional rights get violated. If they fail, people lose money and time fighting the assholes, and the assholes lose nothing.

Any politician or judge who passes a bill/judgment later determined to be Unconstitutional, should be barred from government forever. That would provide incentive not to harm Constitutional rights.

Corporations asking for judgements or lobbying bills that are shown to be Unconstitutional should be dissolved immediately. Individuals doing the same should be fined a percentage of their income from the past five years.

Most state real estate commissions and departments have long had a rule which restricts real estate advertising to "newspapers" and publications owned by brokers. In 1991 or 1992, when I created the Real Estate Center on America Online, I had my attorney contact three states with such rules to ask if it would be lawful to have an online display of properties for sale (in effect, one of the first online MLS systems). As we did not charge to post listings the answer in all cases was yes. However, within our letter was a clear statement referencing First Amendment rights and the idea that the Internet was merely a technological extension of print media.

We believed the rule was impossible to enforce, especially since the Supreme Court had struck down professional advertising bans in the 1970s. It's difficult to imagine a state attorney general defending such a regulation.

I agree 100%! Let's put this into action by booting Obama from office in two months! His NDAA law (he signed it) was just found to be unconstitutional by a Federal court judge. His healthcare law was found to be partially unconstitutional, with several sections struck down. Wouldn't you have to agree?
