AB 1797 will be heard in Assembly Health Committee on Tuesday at 1:30pm. AB 2098 will be heard in Assembly Business and Professions Committee on Tuesday at 9:00am.

Email legislators on the Committees TODAY asking them to Oppose AB 1797 and AB 2098!

AB 1797 Immunization registry, introduced by Asm Akilah Weber would add race/ethnicity to the information recorded in the CA Immunization Registry, would require all vaccines to be entered into the CA Immunization Registry (CAIR). Schools and other entities would have access to all vaccine records, rather than just those of their students/patients or the particular vaccines required for school, during a public health emergency.

AB 2098 Physicians and surgeons: unprofessional conduct, introduced by Asm Evan Low, would designate the dissemination or promotion of misinformation or disinformation related to the SARS-CoV-2 coronavirus, or “COVID-19,” by a physician or surgeon as unprofessional conduct, allowing the Medical Board to take action against such physician or surgeon. Board will base their consideration on “applicable standard of care” and “contemporary scientific consensus” neither of which currently exist for COVID-19.

Immunization registries are managed by each individual state. In the United States today, all 50 states, and several cities and territories, maintain their own registries.

True, but I guess my real point is, Cali is greatly expanding the scope of their registry to include vaccine info not volunteered by the patient and it can be looked up at anytime by pretty much anyone important. It's the "other entities" part that is kinda scary. When I lived in Cali, the only place that needed vaccine info was public schools.

Now, imagine a place where you can't get a job because they did a lookup on your COVID-21 status and now you can't be hired, or you won't receive health care, or maybe you won't receive unemployment benefits because of your vaccine status.

Here in Texas, I've never been asked about my vaccine status anywhere, and I have never had to give that info up to do business in the state, get a DL, etc.

URGENT CALL TO ACTION ON AB 1797

AB 1797 requires all providers to enter patient vaccine data as well as patient race and ethnicity into CAIR (California Immunization Registry), a government vaccine database tracking system.

The hearing for AB 1797, authored by Assemblymember Akilah Weber, has been moved to next week due to “technical difficulties.” Now more than ever, we must keep the pressure on.

CALL TO ACTION: Reach out via phone call, e-mail, and especially social media to Assembly Health Committee members and voice your position on the bill and your concerns. Contact links to committee members listed below.

Also, please submit your formal position to this bill via the California Legislature Position Letter Portal if you haven't yet.
Top Reasons CHD California opposes this bill:

California has a history of database breaches; therefore, the risk of violating patient privacy is significant.
Californians have already experienced discrimination based on vaccine status. If a state of emergency is declared, the Governor could allow businesses and employers to access the CAIR vaccine tracking database.
Requiring race and ethnicity to be entered into the database opens up the opportunity to target these groups with relentless propaganda campaigns and coercion.
A patient’s vaccine information would be an automatic “opt-in” and does not require providers to fully inform patients that they have the right to “opt-out” therefore, the bill violates “informed consent.”
A person’s medical records and decisions are private.
This bill creates government overreach.

California Lawmakers Can't Write Proper Sentences
Preliminary injunction against AB2098 notes unintelligible sentence about "misinformation."

Further evidence that California is now governed by ideologically possessed nitwits was revealed in a preliminary injunction blocking enforcement of California’s AB2098 law. As fellow Substack author, Igor Chudov, notes in his report today, AB2098 was passed to muzzle doctors and prevent them from warning their patients about the dangers of COVID-19 vaccines.

One of the law’s many defects is that it isn’t written in intelligible sentences. For example, consider its definition of the censor’s favorite word:

“Misinformation” means false information that is contradicted by contemporary scientific consensus contrary to the standard of care.

This bill destroys that trust. It destroys the trust between doctors, governments, and patients. The bill feeds into an environment where the government controls the people instead of working FOR the people, as the government was intended to do.

Bill AB 2098 was signed into law on Sep 30, 2022. The bill reads: “This bill would designate the dissemination or promotion of misinformation or disinformation related to the SARS-CoV-2 coronavirus, or “COVID-19,” as unprofessional conduct.”

The bill was sponsored by a group of six legislators from the Democratic party.

Given the bill’s potential for pushing narratives that benefit pharmaceutical companies, it’s noteworthy to mention that four out of the six sponsors took contribution money from Pfizer in 2020: Senator Scott Weiner, Dr. Richard Pan, Assm. Evan Low, and Assm. Cecilia M. Aguiar Curry. ...

According to Dr. Khatibi:

“At one point she (the defense attorney) said ‘Judge, I think we can see that the definition of misinformation is very clear’ – and BOOM! He stopped her and he said ‘No it’s not! It’s not clear at all! The definition of misinformation in this law is not clear, it’s NONSENSE’”

The judge ruled in favor of the physicians. The case will continue on, but the State of California is forbidden to act upon the Bill it passed until the case is decided, in an exciting victory for the Medical Freedom movement.

It’s been a year since I first testified against AB2098. It’s very gratifying that since then, a federal judge has enjoined the state from enforcing this unconstitutional law and that I have the opportunity to act as local counsel on that lawsuit.
